Lawsuit filed in federal court

On June 16, 2005, Karst Environmental Education and Protection, Warren County Citizens for Managed Growth, and three individuals filed suit in federal district court in Washington, D.C. against 3 federal agencies (Environmental Protection Agency, Housing and Urban Development, and Tennessee Valley Authority) over their failure to conduct studies of the Kentucky Trimodal Transpark under the National Environmental Policy Act and the National Historic Preservation Act (an amended complaint was filed on July 29, 2005). The Transpark developer--the Intermodal Transportation Authority (ITA)--the City of Bowling Green, and Warren County, KY, were subsequently added to the suit. The groups and individuals seek a preliminary and permanent injunction and declaratory relief to stop the federal agencies from any federal funding or Transpark approvals until the required studies are done and to prevent the ITA from further construction that harms historic properties or archaeological sites. The briefs are due to be filed from late summer 2005-early fall 2005.
